The Supreme Court of British Columbia approved the Canada iPhone Class Action Settlement in March of this year. As per the settlement, the American Technology company has agreed to settle the lawsuit over alleged defects in older phones and software updates. The current or former iPhone 6 and 7 users are eligible to get a portion of the $14.4 million settlement amount. The class action lawsuit was originally filed in 2018 and aims to provide compensation for the affected iPhone users after the settlement was approved by the B.C. Supreme Court in 2024. Canada iPhone Class Action Settlement
The Canadian citizens who had bought or had an iPhone 6, 6 Plus, 6s, 6s Plus, SE, 7, or 7 Plus smartphone, and updated to the 10.2.1 or 11.2 or later iOS versions before December 21, 2017, are eligible for the Canada iPhone Class Action Settlement. The settlement amount is estimated to range between CAD 11,137,500 and CAD 14,427,500. The citizens of Quebec are excluded from this settlement since there is already a separate class action lawsuit going on in Quebec. The lawsuit was filed in 2018 against Apple and Apple Canada alleged to have concealed performance mitigation features in some of its devices.

In addition to it, the class action lawsuit also alleged defects that resulted in the smartphones being prematurely aged, degraded, and shut down unexpectedly. However, Apple has denied any wrongdoings against the lawsuit and later agreed to settle the case with a settlement worth $11.1 million to $14.4 million earlier this year. As a consequence of the class action settlement, the affected iPhone 6 and 7 users can now get a compensation amount of up to $ 17.50 to $150 once the distribution begins. For that, the class members are required to file a claim submission before the deadline. The class members have until September 2, 2024, to file a claim submission to be eligible for the settlement.

Eligibility Criteria for Canada iPhone Class Action Settlement
As the deadline to file the claim is approaching, the class members are getting ready to apply for the B.C. Supreme Court-approved class action settlement. The affected iPhone users are required to meet the following conditions to be eligible for the Canada iPhone Class Action Settlement:
- Citizenship: the class members should be citizens of Canada (except for Quebec) as of June 15, 2023.
- iPhone 6 users: including 6, 6 Plus, 6s, 6s Plus, SE smartphone and have installed the 10.2.1 iOS version before December 21, 2017.
- iPhone 7 users: including 7, and 7 Plus smartphones and have installed the 11.2 or later iOS version before December 21, 2017.
- Claim submission: must have filed a claim no later than September 2, 2024.
Canada iPhone Class Action Settlement Latest Updates
Throughout the lawsuit, the multinational corporation, Apple has declined any wrongdoing. According to Jill Yates who is Apple’s lawyer at a hearing in Vancouver, “Apple, throughout, has taken a position that it has done nothing wrong here. These claims are novel and they are not ones where Apple agrees that anything was wrongfully done.”
As per the guidelines, while filing a claim form, the class members are required to provide their name, mailing address, and iPhone serial number. Apart from that, a declaration regarding the following things is also must to provided under an oath:
- That their iPhone 6, 6 Plus, 6s, 6s Plus, SE ran iOS version 10.2.1 or later, and their iPhone 7 and 7 Plus ran iOS version 11.2 or later.
- That their device experienced the alleged defects after installing or downloading the respective iOS versions in their devices.
Canada iPhone Class Action Settlement Claim Status
After submitting the claim, the settlement amount for the respective class member will depend on the approval by the claims administrator. The compensation amount may vary ranging between $17.50 to $150 depending on the alleged defects of the device and the class members’ eligibility and other expenses and fees.
